MyProbation - Privacy Statement
We, Her Majesty’s Prison and Probation Service (HMPPS), the Data Controller, of
102 Petty France London SW1H 9AJ are committed to safeguarding the privacy of our users.This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.
What information do we collect?
1) Information that you provide for the purpose of registering to use the App – your name and email address
2) Information about your use of the App – account creations and logins (the App and microsite)
3) Information about your Probation Service interactions – your appointments, messages to and from your Probation Practitioner, requests and resources accessed via the app
How will we use the information that we collect?
1) Supply the services to you and your Probation Practitioner.
2) Notify you about changes to our service.
3) Ensure that content from our site is presented in the most effective manner for you and for your computer/mobile device.
4) Fulfil any request by the Probation Service, Ministry of Justice and associated bodies.
5) Administer our site, including troubleshooting, data analysis, testing, research, statistical and survey purposes.
6) Enable your use of the services available on our site.
7) Send you email notifications which you have specifically requested.
8) Deal with enquiries and complaints made by or about you relating to our site.
9) Fulfil any request by the Probation Service, Justice Department and associated bodies.
10) We will not provide your personal information to any third parties for the purpose of direct marketing products or services.
11) Evaluate the success and effectiveness of this trial to inform future investment.
Lawful Basis for Processing
HMPPS have a lawful duty to prevent and detect crime, and the collection and use of your personal information is also necessary to enable us to perform a public duty, and comply with the obligations of the Offender Management Act 2007.
Who the information may be shared with
The information will be shared with our partner, Unilink Software Limited, who are providing and supporting the App. Unilink will only use the information to troubleshoot problems with the App, and make any changes which are necessary to fix any errors.
How long do we keep your data?
Following the end of the trial your data may be deleted from the App, or it may be kept. If your data is kept, it will be in line with HMPPS data retention rules – please contact your Probation Practitioner for details.
Security of your personal data
We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. We will store all the personal information you provide on our secure servers.
Your rights
Under the Data Processing Legislation:
• You have the right to request us to stop processing your personal data in accordance with this policy at any time. If you make such a request, your ability to use the services will cease.
• If you become aware of any inaccuracies in your personal data which we process on your behalf or such personal data is incomplete, you have a right to request that such inaccuracies are rectified. On receiving your request, we will either action such request or explain why we have decided not to action such request.
• If it is no longer necessary for us to retain your personal data (e.g. You no longer require access to our site, or if you have withdrawn consent for our processing of your personal data, or where it is established that we did not have the right to process your personal data, in accordance with the GDPR, you may have your personal data erased. As explained above, if your personal data is erased, your ability to use the services will end.
• You may also have a right under the GDPR to object to us processing your personal data or to request a restriction on the ways in which we may process your personal data in certain circumstances.
• You have the right under the GDPR to request that we provide to you, or to another data controller on your behalf, a copy of any of your personal data which we have received from you so that you may reuse such personal data for your own purposes across different services.
• You have the right to complain to the information commissioner (http://www.ico.gov.uk/) if you have any concerns in respect of the handling of your personal data by us.
